Terms & Conditions

These terms are the terms and conditions, on which Street Fit supply to you any of the courses and supporting materials listed on our website streetfit.tv and represented by our most current promotional literature.  Please read these terms and conditions carefully before ordering any Services, Courses or product from our site. You should understand that by ordering any of our Services, Courses or products, you agree to be bound by these terms and conditions.

1.  Price and Payment

1.1  The price of any Courses/products will be as quoted on our site or on our promotional literature, except in cases of obvious error.  Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Confirmation.

1.2  The monetary value of the Street Fit Instructor Training Course is £41.67 + VAT

1.3  The monetary value of the Street Fit 1st year license and training materials is £195.83 + VAT (prices subject to change)

1.4  Our site and promotional literature refer to a number of Courses and it is always possible that, despite our best efforts, some of the Courses listed on our site may be incorrectly priced.  We will normally verify prices as part of our dispatch procedures so that, where Courses correct price is less than our stated price, we will charge the lower amount when dispatching the Confirmation to you.  If Courses correct price is higher than the price stated on our site or in our promotional literature, we will normally, at our discretion, either contact you for instructions before the Confirmation, or reject your order and notify you of such rejection.

1.5  We are under no obligation to provide Courses to you at the incorrect (lower) price, even after we have sent you a Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a miss-pricing.

1.6  Payment for all Courses can be made by credit or debit card, cheques, PayPal or through our website link on streetfit.tv and received by us in cleared funds prior to your attendance on the Course. We accept payment with Visa, and MasterCard.  We will not charge your credit or debit card until Course Confirmation. Cheques should be made payable to Trap Fitness Ltd. All balances must be paid 7 working days before the course if a deposit was paid, unless your deposit will be invalid.

2.  Refunds Policy

All deposits are non-refundable.  Course fees are applicable to cancellation as below: –

All license fees and course materials are non-refundable outside cancellation period.

2.1  Group Instructor Training Days – Your Street Fit Become An Instructor Course can be cancelled up to 30 working days before the date the course is due to take place. A £50 Admin charge is applicable. Should you choose to cancel the course inside 30 working days of the course being due to take place the full course fee and license fee is applicable and no refund will be made.

2.2  Elearning and  on line Members area – All Elearning distance learning program including on-line membership and SF Kids once purchased is a non refundable membership. You have a choice not to continue your membership after the minimum 6 month period, if you have chosen to pay monthly or after your year membership expires should if you have purchased under the year membership deal.

2.3 To request a refund for the Group Training Dates, you must inform us in writing, by sending a written notice of cancellation to Street Fit, Street Fit C/O Creative Volt Ltd, 22 Hanover Square, Mayfair, London, W1S 1JP. If a refund is payable to you we will process the refund as soon as possible, and, in any case within thirty (30) days of the day you give written notice of cancellation.

2.4 There maybe circumstances beyond our control whereby we may need to cancel your course. For example if a Studio hired should cancel on us at short notice due to liquidation, flooding, refurbishing. If a trainer should fall sick, or if the trainer/participants should experience travel difficulties brought about by adverse weather conditions. Should any such situation arise, we will make every effort to minimise disruption and replace with a suitable and comparable alternative, which will be discussed with you beforehand. Please note no monetary refunds will be made if these issues have not been brought on by Street Fit.

2.5 One to one sessions are non – refundable. All online and Elearning courses are non refundable once purchased.

2.6 Instructors who wish to change course i.e. to a later date or location will incur a £35 admin charge. This is if the reason for changing is due to bad health, injury, pregnancy and or including unforeseen circumstances. This is done as GOODWILL to cover the admin costs of preparing course materials, for any reason the course does not go ahead the transfer fee will be refunded. This does not include the 30day cancellation policy for the new course.

2.7 If pregnant we strongly advise you not to go on the course. The course may present a health risk to you and your unborn child and we will not be held responsible for and injury or damages to yourself or unborn child.

2.8 If an instructor falls pregnant after they have booked onto the course, we will gladly move you to a date 12 weeks after the baby has been born. This will incur a £35 admin fee.

2.9 Online Membership – on-line membership is a annual subscription taken through PayPal. You can cancel the automatic renewal of your membership subscription at any time right through your PayPal account. Once your membership is renewed; membership charges are non-refundable and must be cancelled prior before the renewal date. If you prefer to have us cancel a membership for you, we require at least a week’s notice in order to process the request. You can immediately cancel a membership at any time on your own using your PayPal page. You will need to also renew your Instructor licence to continue to use the licensed resources in the members area. Your account and membership will stay active for 1 year if your Licence is not renewed as goodwill. After 1 year of failure to renew your licence. Your members area and your account will be deleted and all account information will be purged.

2.10 Cancellation Policy In the event that you notify us that you wish to cancel or postpone the Confirmed Course prior to the time of commencement, you shall do 24 hours or more in advance of your scheduled Course.  If you notify us less than 24 hours in advance of your Confirmed Course, and you have already paid for the same, the Fee is not refundable and you agree that we cannot guarantee you room on the next available course, but we will try our utmost best to meet your requirement.

4.  Assessment Procedure

  • To successfully complete the course participants must:
  • Complete the multiple choice assessment and a practical assessment which will be observed by the trainer.
  • The result of both assessments will be added together to give the final result.

5.  Process for failing instructors

An instructor fails the course when they have been unable to achieve the criteria for the written and or practical assessment. The pass mark is no more than three fails on written assessment and no more than two on practical assessment. If the pass mark is not reached the following steps need to be taken when failing an instructor.

5.1 Provide Feedback – During the wrap up session one to one feedback should be provided to the instructor detailing the areas for improvement, positives to build upon and the steps they need to take to enroll in the next course. They should be provided with the DVD form the instructor pack to help practice.

5.2 Enrolling in next course – A £50 admin fee is applicable Instructor should be advised to contact the Street Fit Office to confirm book their space. It is recommended that they have at least two weeks to build their skills before attending.

5.3 No improvement – there is no cap on the number of times an instructor can retake the course. A £50 admin fee is applicable for each retake.

5.4 Appeals – In the event that you wish to dispute your marks and/or the reasons given for failing the training day, you may email hello@streetfit.tv to request an appeals form. You must fill out this form and send it back to us together with any relevant additional evidence. All appeals must be sent to us within 14 days of your course date.

5.5 Change of Venue – In rare circumstances, we reserve the right to change the venue at short notice. We will locate the closest venue to the one advertised. We will try as much as possible to give you adequate notice; you will be informed via email/text on changes to venue.

6. Clothing Returns Policy

6.1 If your goods are faulty you may cancel your order within seven (7) working days, beginning on the day after you received the goods. We will refund the price of the goods in full and will reimburse you for the delivery costs you paid except where multiple items have been ordered and not all of them are being returned (items must be faulty). If your items are not faulty we can issue an exchange, however you will be responsible for the cost of returning the goods to us. If a refund is payable to you we will process the refund as soon as possible, and, in any case within thirty (30) days of the day you give written notice of cancellation.

6.2 To cancel an order, you must inform us in writing. You must also return the goods to us as soon as possible, intact and in their original packaging, and at your own cost and risk.

6.3 You have a legal obligation to take reasonable care of the goods while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. This applies to all goods that are returned.

6.4 Our returns policy does not affect your statutory rights.

6.5 If you return goods claiming they are defective, we will examine the returned goods and will notify you of your refund via e-mail within a reasonable period of time. We will process the refund due to you as soon as possible and, in any case within thirty (30) days of the day we confirm via e-mail that you are entitled to a refund for defective goods.

6.6 If a refund or reimbursement is payable to you, we will transfer the money using the same method originally used by you to pay for your purchase.

6.7 Any orders for personalised goods are non-returnable. Some goods are non-returnable for hygiene reasons. Please note that this does not affect your statutory rights.

6.8 For all returned items, please email your reason for the return to us at hello@streetfit.tv along with full details of your order. Once this has been received by our customer service team you will receive instructions regarding where to post your returned item(s). Within the package, please also confirm your name and address and the date of purchase.

7. Clothing Delivery Policy

Please note that adverse weather conditions may affect the speed of your delivery.  This is out of our control and we apologise for any delay that weather conditions may cause.

7.1 We aim for orders placed depending on stock to be dispatched the same day if placed by 3pm Monday to Friday, for delivery within 3 working days. Orders received after 3pm will be processed the following day and any orders received on a Saturday, Sunday or on a bank holiday will be processed the next working day. We cannot guarantee next day delivery.

7.2  If you live in the Scottish Highlands and Islands, Isle of Wight, Isle of Man, Northern Ireland and Eire your delivery will take 3 to 5 days to arrive.  Please note that we cannot guarantee delivery within the described period.

7.3 Postage costs are subject to change and are displayed when you reach the checkout on our online shop. Please note for orders outside of the UK postage costs will increase.

8. Referral Policy

8.1 Anyone can earn £50 referral fee you need to ensure the person booking quotes your name at the time of booking on the phone or via the website comment box and you need to inform Street Fit head office.

8.2 If you refer someone who has used any of our offers £25 will be paid to, £50 referral fee is based on the person paying full price for a course with no offers used.

8.3 Please allow 30 days for your referral fee to be processed. You referrer must first complete the course before payment is released. You will need to send an invoice to our office.

9.  Our Liability

9.1  Street Fit is not liable for failure to comply with these terms and conditions due to any event beyond its reasonable control, including, without limitation, the input of incorrect information by you.

9.2  The Site or documents sent with a Product, or the packaging or labeling of a Product may contain instructions for use, warnings, contra-indications and other notices.  You must read and follow these notices carefully and ensure others who use the Products do so.  Subject to the important liability statement, we will not be legally responsible to you if any of these are not observed.

9.3  We warrant to you that any Course or product purchased from us through our site is of satisfactory quality and reasonably fit for the purpose for which the Course or product is supplied.  This does not include or limit in any way our liability for death or personal injury caused by our negligence; under section of the Consumer Protection Act 1987; for fraud or fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

9.4 We are not responsible for indirect losses which happen as a side effect of the main loss or damage, including but not limited to loss of income or revenue, loss of business, loss of profits, contracts or potential contracts or loss of anticipated savings.

9.5  We are not liable for additional costs due to changes in courses, content, venues or trainers.  Every effort will be made to provide reasonable notice where possible.

10.  Communications

When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. You agree to this electronic means of communication and you acknowledge that most contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

11.  Obligations

The Contract where applied between you and us is binding on you and us and on our respective successors and assigns.  You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.

12.  Intellectual Property Right

12.1  All intellectual property rights (including, without limitation, copyright, moral rights, design rights, trademarks and patents) and all other rights in the Course content and Course materials belong to Trap Media Limited.  We licence to you all such rights on a non-exclusive basis for the purpose only of enabling you to attend, participate and, where you are able, to complete our Courses.  Reproduction or distribution of our Course content and Course materials is strictly prohibited.

12.2  Use of our Street Fit logo is strictly prohibited without our prior written consent.  An audio and visual recording of our Courses is strictly prohibited without our prior written consent.  Occasionally we may film or record Course trainers delivering our Course during your attendance.  You authorise us to use your image and voice in any such recordings without payment, other condition or need for further consent.

12.3  You acknowledge that certain information contained in our Courses and Course materials is already in the public domain. Street Fit trainees are not permitted to sell or promote products or services at Street Fit events without prior written permission.

13.  Confidentiality

Confidentiality is required by law or in respect of information which is already in the public domain through no breach by you, therefore you shall keep in strict confidence all technical and commercial know-how, specifications, inventions, processes or initiatives which are of a confidential nature and have been disclosed to you by us (or our employees, agents, consultants or sub-contractors) and any other confidential information concerning our business, products or our Courses or Course material which you may obtain.  You shall not use any such information for any purpose other than to attend, participate and where capable, complete Street Fit Courses provided.

14.  Password

As part of the Services offered via this Site, you may be issued with an individual password which can be used to access the Plan areas of the Site and provide fast checkout. You will use the password only for such access and not for any other purpose. You must keep your password confidential at all times, and must not disclose the password or permit anyone else to use your password. Any breach of any of these terms by anyone to whom you disclose the password will be treated as if the breach had been committed by you, and will not relieve you of your obligations under these terms and conditions.

15.  Entire Agreement

15.1  These terms and conditions and any document expressly referred to in them represent the entire agreement between Street Fit in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

15.2  Our right to change these terms and conditions

Street Fit has the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

16.  Law and Jurisdiction

Contracts for the purchase of Street Fit Courses or Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law and all disputes and claims shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17.  Street Fit Courses Terms and Conditions

Any Street Fit courses made by you with us following your receipt of these terms and conditions will be deemed your acceptance of these terms and conditions. For courses or workshops supplied by Street Fit subject to the following express terms and conditions (“the Terms”). In these Terms, “we”/”us”/”our” which means Street Fit, and “you”/”your”/”yours” means you, the client. The Terms shall not be changed in any way whatsoever unless agreed in advance in writing between the parties.

18.  Payments

18.1  For Street Fit Courses or Products; payment of the Fee by you to us shall be immediately and by  either cheque, cash, PayPal or through our website streetfit.tv  to be paid in full when booked or ordered.

18.2  Payment of all sums shall be made in pounds sterling and if paying by cheque it should be made payable to Trap Fitness Limited.

You understand and agree that, in the event that if you fail to comply with Street Fit Terms and Conditions, we reserve the right to: (a) charge interest on any late payment in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, on the amount unpaid. And (b) claim compensation for any reasonable debt recovery costs incurred by us from you should any action be undertaken to obtain settlement of the account. “Fee” means the sum payable by you to us for the Courses or products.

19.  Service

We agree to supply the Services to you and you agree to pay the Fee for the same subject to these Terms.  The exact date and time of our supply of the Services and of the amount of the Fee shall be agreed in advance between the parties and shall be notified to you by us either by telephone, post, email or online notifications.  No changes to these Terms shall be binding unless agreed in writing and signed by both parties.

20.  Independent Trainer Status

Street Fit has many successful trainers associated as independent contractors.  Nothing herein will be deemed or construed to create an employer-employee, joint venture, partnership, or agency relationship between Trap Media Limited and Street Fit and you for any purpose whatsoever unless agreed.

21.  Our Responsibility

We shall endeavour to provide the Courses and Products in accordance with these Terms. In the event that we cancel the Courses, for any reason, we shall offer you a new date for the Courses and no additional Fee shall be payable by you.  If such date is not reasonably acceptable to you we find a suitable date that fits your requirements.

22.  Your Responsibility

You shall: (a) co-operate with us as reasonably necessary in order to enable us to provide the Courses; and (b) notify us of if you have any special requirements relating to the Courses prior to us providing the Course.

23.  Termination

We reserve the right to terminate the Contract immediately without liability if you fail to complete the required pass level in a Street Fit Course and have turned down the opportunity to re-try on the next available course date suitable for yourself, but the course must be completed within a 6 month period.

24.  Limitation of Liability

24.1  We shall not be liable to you (excluding for personal injury or death, fraud, or wilful default) for any loss or damage (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, and whether in tort (including without limitation negligence, contract or otherwise) that may result in connection with the Courses.

24.2  Our liability to you shall at all times be limited to the amount paid by you for the Courses or Products.

25.  Notices

All notices to be given under these Terms will be by telephone, post, online form or by email. Written notices shall be deemed served when received.

26.  Force Majeure

We shall not be liable to you or deemed to be in breach of these Terms by reason of any delay in performing or any failure to perform any of our obligations in relation to the Services, if the delay or failure was due to any cause beyond our reasonable control.

27.  Severability

If any part of these Terms is found by a court of competent jurisdiction to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

28.  Entire Agreement

These Terms together with our booking confirmation constitute the entire agreement between the parties and shall exclude any other agreement, or understanding of any kind, whether oral or written, relating to the Courses.

29.  Governing Law and Jurisdiction

These Terms shall be governed by English law and all disputes and claims shall be subject to the exclusive jurisdiction of the courts of England and Wales.

30.  Street Fit Online License Main Points

30.1 Trademark can only be used within the EU

30.2  Prices for online membership:

£80 per year – non refundable

30.3  To become an online member you must be a qualified Street Fit Instructor.

30.4  We have the right to freeze or withdraw your online membership if you miss a month’s payment.

30.5  We also have the right to withdraw your license should you at any time be damaging the brand.

30.6  All media enquiries should be made through Trap Media Ltd

30.7  DVD is not for use outside of personal training (i.e can’t use within class or public domain, for home use only.

31. Complaints Procedure

31.1 We will fully investigate every complaint about our services.

31.2 We want to resolve your complaint as soon as possible, you need to make sure that your complaint reaches us in writing either to hello@streetfit.tv or to our booking office address sound online at streetfit.tv.

31.3 Once we have received a complaint you will receive an automatic response indicating your complaint has been received.

31.4 Please be patient it will take 7 to 14 days to get a response from our complaints team.

31.5 We provide you with a formal resolution letter/email, as part of our procedure. In most cases reaching this stage, we will be able to resolve your complaint within two weeks of receiving it.

31.6 In exceptional circumstances, particularly where your complaint is complex, it may take over eight weeks to resolve matters for you. We will, however, write to you at that point to let you know.

31.7 If you’re unhappy with our response to your complaint, you can ask for a further review. We are committed to resolving your complaint to your satisfaction and hope that together we can reach an agreement.

32. Street Fit® Liability Waiver/Release Form

For and in consideration of Trap Media Ltd (“Street Fit”) permitting the participant to enroll and participate in the Trap Media (“Street Fit”) Instructor Training (“Instructor Training”), Participant, by signing below, hereby voluntarily indemnifies, releases from liability, and holds harmless Trap Media Ltd for any accident, injury, illness, death, loss, damage to person or property, or other consequences suffered by Participant or any other person arising or resulting directly or indirectly from Participant’s participation in the Instructor Training. In the event that Participant is injured, Participant agrees to assume any financial obligation, either through Participant’s personal health insurance, or through some other means, for any medical costs which Participant incurs. Trap Media Ltd assumes no responsibility for any medical expenses, injury, or damage suffered by Participant in connection with the use of any facilities or services in connection with the Activity.

IT IS THE INTENTION OF PARTICIPANT BY ACCEPTING THESE TERMS AND CONDITIONS TO EXPRESSLY ASSUME ALL RISK OF PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE UPON HIM/HERSELF, TO THE EXCLUSION OF TRAP MEDIA LTD AND TO EXEMPT AND RELIEVE TRAP MEDIA LTD FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH.

Participant further agrees that Participant, his/her spouse, assignees, heirs, guardians, and legal representatives will not make any claim against, sue or approach Trap Media Ltd for any loss or damage resulting from Participant’s participation in the Activity.

PARTICIPANT IS AWARE OF THE POTENTIAL DANGERS INCIDENTAL TO ENGAGING IN THE FITNESS ACTIVITIES IN THE INSTRUCTOR TRAINING. PARTICIPANT AGREES THAT THIS IS A RELEASE OF LIABILITY. A WAIVER OF THE PARTICIPANT’S LEGAL RIGHT TO COLLECT DAMAGES IN THE EVENTOF INJURY, DEATH OR PROPERTY DAMAGE AND A CONTRACT BETWEEN PARTICIPANT AND Trap Media Ltd AND PARTICIPANT SIGNS IT OF HIS/HER OWN FREE WILL.

Participant, by accepting (‘ticking’) below, voluntarily indemnifies, releases from liability, and holds harmless Trap Media Ltd for any claims of negligent instruction that may arise from participant teaching, holding or hosting a Street Fit® class.

PARTICIPANT ACKNOWLEDGE THAT HE/SHE IS 18 YEARS OF AGE OR OLDER.

Consent and Release for Interview, Photographing, Videotaping and/or Web Site Use for Street Fit® Course I consent to interview(s), photography, videotaping and its/their release, publication, exhibition, or reproduction to be used for public relations, news articles or telecasts, podcasts, education, advertising, research, inclusion on web sites, fundraising, or any other purpose by Trap Media Ltd and/or its affiliates.

I release Trap Media Ltd, their officers and employees, and each and all persons involved from any liability connected with the taking, recording, or publication of said interviews, photographs, slides, computer images, videotapes, or sound recordings.

I waive all rights I may have to any claims for remuneration in connection with any exhibition, televising, or other publication of these materials, regardless of the purpose or sponsoring of such exhibiting, broadcasting, or other publication irrespective of whether a fee for admission or film rental is charged.

I also waive any right to inspect or approve any photo, video, or film taken by Trap Media Ltd and/or the person or entity designated it by it. I release and discharge Trap Media Ltd and their affiliate(s) from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of the pictures, or in any processing toward the completion of the finished product.

All creative production whether prints, video, film, or sound recording, choreography are the property of Trap Media Ltd and/or the person or entity designated by it, solely and completely.

I declare that I am eighteen (18) years old or older and am legally competent to execute this release or that I have acquired the written consent of my parent or guardian. I understand that the terms herein are contractual and not a mere recital, that this instrument is legally binding, and that I have voluntarily signed this document. I have fully informed myself of this consent, waiver of liability, and release before signing it.

33. Consent and Release for Interview, Photographing, Videotaping and/or Web Site Use for Street Fit® Course

I consent to interview(s), photography, videotaping and its/their release, publication, exhibition, or reproduction to be used for public relations, news articles or telecasts, podcasts, education, advertising, research, inclusion on web sites, fundraising, or any other purpose by Trap Media Ltd and/or its affiliates.

I release Trap Media Ltd, their officers and employees, and each and all persons involved from any liability connected with the taking, recording, or publication of said interviews, photographs, slides, computer images, videotapes, or sound recordings.

I waive all rights I may have to any claims for remuneration in connection with any exhibition, televising, or other publication of these materials, regardless of the purpose or sponsoring of such exhibiting, broadcasting, or other publication irrespective of whether a fee for admission or film rental is charged.

I also waive any right to inspect or approve any photo, video, or film taken by Trap Media Ltd and/or the person or entity designated it by it. I release and discharge Trap Media Ltd and their affiliate(s) from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of the pictures, or in any processing toward the completion of the finished product.

All creative production whether prints, video, film, or sound recording, choreography are the property of Trap Media Ltd and/or the person or entity designated by it, solely and completely.

I declare that I am eighteen (18) years old or older and am legally competent to execute this release or that I have acquired the written consent of my parent or guardian. I understand that the terms herein are contractual and not a mere recital, that this instrument is legally binding, and that I have voluntarily accepted sections 33. and all other sections of the Terms & Conditions by checking the box below (ticking box). I have fully informed myself of this consent, waiver of liability, and release before accepting (ticking) it.
